1. I
will follow College rules and procedures and any policies and directions posted
or provided to me by SF regarding use of the Fitness Center and I will use equipment in a safe
manner. If User is a SF student, this includes the Student Conduct Code.
2. I
agree my use of the Fitness
Center and participation in the activities is completely voluntary.
3. I will not share my SF ID Card with or to
permit access to the Fitness Center to another person.
4. I understand that there are hazards and
inherent risks incidental to participation in training, exercising, and use of
fitness equipment and that I may sustain injuries, whether minor or serious and
whether acute or chronic, such as bodily harm, broken bones, sprains/strains,
exhaustion, pain, sores, swelling, disease, illness, infections, concussion, permanent
paralysis, heart attack, or death. I knowingly ASSUME THE RISKS including but
not limited to those listed. I understand it is
recommended that I seek assurances from my physician before beginning the
activities or implementing an exercise regimen, as there may be significant
health risks associated with the activities. I declare myself to be physically
sound and suffering from no condition, impairment, disease, infirmity, or other
illness that would prevent my use of the Fitness Center and participation in
activities at the Fitness Center. I expressly acknowledge that any “fitness
testing” that I participate in at or with SF is voluntary and is done merely
for medical advice, informational purposes and not for the purposes of
diagnosis or treatment and that said testing and any results in no way declare
whether I am fit or not for the activities.
5. In
the event of an emergency, illness, or accident, I on behalf of myself/the User (or on behalf of my child/ward)
authorize SF and its employees to arrange and to obtain and give consent to
whatsoever medical care, treatment and/or transport
as deemed necessary or in the User’s best interest. I, on my own behalf or on behalf of my child/ward,
do hereby INDEMNIFY, DEFEND, HOLD HARMLESS, PROMISE
NOT TO SUE, AND FOREVER DISCHARGE The District Board of Trustees of Santa Fe
College, Florida, and its trustees, officers, coaches, officials, agents,
volunteers, and employees (collectively “SF”), from and against any and
all liabilities, claims, demands causes of action, and damages, including
attorneys’ and costs, WITH RESPECT TO or related to SF
obtaining and consenting to said medical care, treatment and/or transport, WHETHER ARISING FROM THE NEGLIGENCE OF THE SF OR OTHERWISE
and agree that I (not SF) am responsible for the cost, if any, of such medical
care, treatment and/or transport.
6. I, on behalf of myself, on behalf of my child/ward, and on behalf of User’s
heirs, beneficiaries, administrators, personal representatives and next of kin,
agree to INDEMNIFY, DEFEND, HOLD HARMLESS, PROMISE NOT TO SUE, AND FOREVER
DISCHARGE SF, from and against any and all liabilities, claims, demands,
causes of action, and damages, including attorneys’ fees and costs, that User
may have or that may hereafter accrue, with respect to or which may have arisen
or is connected with User’s participation in the activities
or use of the Fitness Center WHETHER ARISING FROM THE NEGLIGENCE OF THE SF OR OTHERWISE. I fully understand that this release and agreement to indemnify includes
and covers any liability, claims, and actions based on, in whole or in part,
the negligence, action or inaction, whether actual or alleged, of SF and covers
bodily injury and property damage, whether suffered by me (or my child/ward)
before, during, or after such activities or use. By signing this form, I WAIVE,
RELEASE AND DISCHARGE any right I might have TO SUE SF in connection with any
such liability and damage. Venue for a proceeding concerning this release is in
Alachua County, FL.
7. SF
is not responsible for any lost, damaged, or stolen property.
8. SF reserves the right to limit or
refuse access by a person to the Fitness
Center if such person does not comply with
College rules, procedures, policies or federal, state or local laws. SF
reserves the right to close the Fitness Center, in whole or in part, for any reason.
